Privacy and cookie policy

This Website Privacy and Cookie Policy ("Website Privacy and Cookie Policy") applies to the website operated by Medaxis AG, Bahnhofstrasse 9, 6340 Baar, Switzerland ("Medaxis" or "we") www.medaxis.ch (including all subpages) and/or other Medaxis websites ("Website"). Other websites that are directly or indirectly linked to our Website - e.g. through hyperlinks - do not fall within the scope of this Website Privacy and Cookie Policy, regardless of whether they are operated by Medaxis, an affiliated group company or a partner company.

This Website Privacy and Cookie Policy applies to the collection, processing and use of your personal data when you visit and/or interact with our website and explains our practices with regard to the placement of cookies, including the types of cookies we use and how you can manage them.

Website Privacy and Cookie Policy, last amended on 07.12.2017.

1. collection, processing and use of your personal data

1.1 Anonymous use of our website

You are welcome to visit our website anonymously without providing your personal data.

However, on your first visit to our website, we will ask for your consent to place additional cookies on your device and to track your user behavior in relation to our website. This allows us to better understand how customers use our website and to improve our website's offering and services, which also allows you to benefit from a more personalized website experience and targeted offers. If you have subscribed to our newsletter (see section 1.2 below), we also use such user information to send you personalized communications according to your specific interests and preferences. You will find detailed explanations of the cookies and website analysis tools that we use for this purpose and your right to object in sections 2.2, 2.4 and 2.5 below.

If you do not agree with the above procedure and wish to remain completely anonymous, you can use the available deactivation mechanisms to indicate that you do not give your consent or revoke it for the future (see sections 2.2, 2.4 and 2.5 below). In this case, we only collect certain anonymous data that is not directly related to your person. For example, we may record the number of visitors to our website, browsing patterns and areas of interest. We analyze this information in order to understand how our customers use our website and to evaluate trends, statistics and the needs of our customers so that we can improve our website and the service for our customers.

Unless otherwise stated above, we will only collect your personal data if you provide it to us voluntarily, e.g. by submitting an inquiry or requesting a specific service. Without your express consent and unless otherwise stated in this Privacy Policy, we will only use the personal data you provide to the extent necessary for the use of our website by you, including the processing of your inquiries and the provision of the requested services. In addition, we may use personal data that we receive exclusively in anonymized form (i.e. in a non-identifiable form that does not allow any conclusions to be drawn about your identity) for statistical purposes and for internal evaluation with a view to improving our products and services. Your data will not be processed for any other purposes or beyond the scope of this privacy policy, unless this is expressly permitted or required by law.

1.2 Registration for the newsletter

Cookies are small text files that our website wants to place on your computer or other internet-enabled devices such as tablets or smartphones. If your browser settings accept cookies, your browser will add the text in a small file.

Unless otherwise stated in this Website Privacy and Cookie Policy, the cookies we use are necessary for the functionality and performance of our website, for example because they allow our website to operate more efficiently and facilitate your use of the functions and services offered; these functional and/or performance cookies are deleted from your device at the end of your browser session (session cookies). We use the information stored in the necessary cookies exclusively to provide you with the requested services and functions.

2. cookies

2.1 Necessary cookies

You are free to subscribe to our newsletter. If you do so, we ask for your consent to store and process your name and e-mail address. We use such data exclusively to send you regular updates by e-mail about Medaxis services and products. As part of your registration, we also obtain your consent to personalize the content of our newsletter according to your needs and interests on the basis of the data received from you and stored about you, such as your account information, order history or other information you have provided (including, for example, your participation in surveys). If you have also given us your consent to place cookies and to track your user behavior on our website (see section 2.2 below), we will use data about your use of our website to send you personalized messages according to your specific interests and preferences.

After registering for the newsletter, you will receive a confirmation e-mail with a link that you must click on to confirm your registration. This double activation procedure helps us to ensure that the owner of the e-mail account agrees to receive our newsletter.

The wording of your declaration of consent, which you give when you register for our newsletter, is listed at the end of this website Privacy and Cookie Policy.br>

By subscribing to our newsletter, you also consent to your use of our newsletter, such as email opens and email clicks, being recorded by Medaxis using an analysis tool from Campaign Monitor Pty Ltd, Level 38, 201 Elisabeth Street, Sydney NSW 2000 (Australia) ("CampaignMonitor"). This tool also collects data on email forwarding, undeliverable emails and unsubscriptions. The data collected by CampaignMonitor includes your name, email address and location.

Our service providers process this data as our data processors exclusively on our behalf and in accordance with our instructions in order to facilitate the analysis of the use of our newsletter, to personalize your newsletter messages, to create reports on newsletter activities and for other statistical and analytical services in connection with the use of our newsletter. Your data will not be used for any other purpose.

As these service providers may be located in a country that may not provide the same level of data protection as is considered appropriate in your home country, in particular Switzerland and the EU/EEA, we have taken the necessary measures to ensure that your personal data is adequately protected when transferred outside Switzerland and/or the EU/EEA.

You can unsubscribe from our newsletter at any time by clicking on the "unsubscribe" link at the end of the newsletter e-mails you have received or by sending an e-mail or post to the contact details provided in section 9 of this Website Privacy and Cookie Policy.

2.2 Cookie consent and personalized tracking

When you visit our website, we ask for your consent to place additional cookies on your device by displaying a cookie banner ("cookie consent"). These cookies are not strictly necessary for the functionality and performance of our website, but help us to collect some of your personal data in connection with your user behavior on our website in order to improve the offer of our website and our services or to provide you with more personalized information, including targeted offers (see sections 2.4 and 2.5 below for corresponding cookies placed for the purpose of web analytics and remarketing). If you have subscribed to our newsletter (see section 1.2 above), we will also use such website user information to send you personalized messages according to your specific interests and preferences. With your cookie consent, you also agree to the placement of cookies to activate the ShareThis service (see section 3 below).

The cookie banner informs you about the main purposes of additional cookies as well as your options and where you can obtain further information. By continuing to use our website after the cookie banner has been displayed, you agree to the procedure described.

The wording of the cookie consent declaration can be found at the end of this Website Privacy and Cookie Policy. Below we explain the categories of non-essential cookies that may be stored on your device and their respective purposes in relation to the different services (see sections 2.4, 2.5 and 3). You are entitled to revoke your cookie consent at any time with effect for the future and to decide individually against the placement of cookies and the collection of your data for the various purposes, see further explanations under the corresponding sections 2.3, 2.4, 2.5 and 3 below.

2.3 Managing your cookie settings

Most browsers are set to accept cookies by default. If you wish, you can change your settings so that cookies are generally rejected, cookies already stored on your device are deleted or you receive a warning before a cookie is stored. Please refer to the instructions for your browser or visit www.aboutcookies.org or www.allaboutcookies.org to find out how to adjust or change your browser settings.

If you do not allow cookies, this may affect the usability of the website and some of our features and services may not be available to you.

If you use different devices to access our website (e.g. smartphone, tablet, computer, etc.), you must ensure that each browser on each device is adjusted according to your cookie preferences.

2.4 Use of Google Analytics

This website uses Google Analytics ("Google Analytics"), a web analytics service provided by Google, Inc ("Google"). Google Analytics uses cookies to help us analyze the use of our website, including the number of visitors to our website, the web pages from which our visitors come and the pages they visit. This data is used by us to improve our website offering and our services. As a rule, all data generated by the cookie about your use of our website is transmitted by Google to servers in the USA and stored there.

Google uses this data as our data processor to help us analyze the use of our website, to compile reports on website activity and for other statistical and analytical services related to the use of our website. The IP address transmitted by your browser as part of Google Analytics is not linked to other data managed by Google.

You can prevent the collection of data generated by the cookie about your use of this website (including your IP address) and deactivate tracking by Google Analytics across all websites by downloading and installing a browser plugin here.

As an alternative to installing the browser plugin or in the event that you access our website via browsers on mobile devices, you can also deactivate tracking by Google Analytics by clicking on the following link: Deactivate Google Analytics.

In this case, a so-called "opt-out cookie" is stored in your browser, which prevents Google Analytics from tracking your use of this website. Please note that you must reactivate the deactivation if you delete all cookies stored on your device.

You must also deactivate it on every device that you use to access our website.

An overview of Google's privacy policy can be found here.

2.5 Use of the advertising features of Google Analytics

Depending on the pages you visit on our website, we also use certain advertising features of Google Analytics, such as reports on demographic characteristics and interests, as well as remarketing features.

To enable these features, Google stores a so-called DoubleClick cookie from a third-party provider on your device (if you access certain pages of our website or websites of other providers that have implemented advertising features based on DoubleClick cookies).

The DoubleClick cookie stores information about your use of our website (and possibly other pages accessed in the Google advertising network), including the pages visited, ad views, page views, user interaction data, browser information, IP address, a cookie ID and your search history. Google will not link your name or other personal data to your DoubleClick cookie without your prior consent.

We use Google Analytics to analyze the data stored in the DoubleClick cookie in order to obtain statistical reports on the demographic data of our users (age, gender) and their interests. These reports help us to better understand our users and improve our website and services.

In addition, we use remarketing features of Google Analytics to run advertising campaigns (including Google AdWords) for users of our website. Based on your previous visits to our website (as well as the interests shown during these previous visits), these users receive appropriately targeted advertising when surfing other websites within the Google advertising network. We may also use the advertising features of Google Analytics to measure the effectiveness of advertising campaigns.

Please also note that the DoubleClick cookie enables Google and other third-party providers to target advertising (based on your previous visits to our website and/or other websites). These ads may be displayed on websites of Google and/or other providers participating in the Google advertising network.

You can manage your preferences and opt-out of Google's interest-based ads in your Google ad settings. In this case, the unique cookie ID of the DoubleClick cookie will be overwritten and cannot be associated with a specific browser. Please note that a new DoubleClick cookie may be stored if you delete all cookies from your device and you may therefore need to renew your opt-out settings.

If you wish to deactivate the DoubleClick cookie permanently, please download and install a corresponding browser plug-in here.

In addition, you can deactivate the use of cookies by third-party providers for online advertising via the US-based site aboutads.info.choices or the EU-based site Your Online Choices.

An overview of Google's privacy policy can be found here.

2.6 Other third-party cookies

Some content or applications, including advertisements, on the website may originate from third-party providers not affiliated with us. They may store cookies on your device for their own purposes. We do not control these third-party tracking technologies or their use.

You can prevent the storage and tracking by such third-party cookies by adjusting or changing your browser settings accordingly. For more information, please refer to the instructions for your browser.

3. shareThis social plugin

This website uses a social plugin of the ShareThis service ("ShareThis plugin"), which is operated by ShareThis Inc, 4005 Miranda Avenue, Suite 100, Palo Alto, CA 94394 USA ("ShareThis"). The ShareThis service allows users to share content from our website more easily via social networks such as facebook.com, twitter.com, LinkedIn.com and pinterest.com ("Social Networks").

When you access a page from our website that contains the ShareThis plugin, your browser may establish a direct connection to the ShareThis servers and load the ShareThis plugin and its content onto your browser in order to integrate it into the website you are visiting. The ShareThis plugin places cookies on your device and informs ShareThis that you have accessed the corresponding page from our website. Further data may be collected when you interact with the ShareThis plugin, e.g. when you click on the ShareThis icon and/or share content with the sharing icons. The data collected by ShareThis may include user data, including your IP address and geographical location, as well as technical data, such as the type of browser or operating system used.

According to the ShareThis Privacy Policy, your information is used to collect non-personal, demographic and behavioral data (to group users with common interests into audience segments), for other related purposes (such as better understanding the interests or activities of users of ShareThis services), and for statistical analysis of site usage. ShareThis does not store or use personal data without your consent.

If necessary, your browser may also establish a direct connection with the servers of the social networks implemented in the ShareThis plugin when you call up a page from our website that contains the ShareThis plugin. These social networks may store cookies on your device for their own purposes and transmit personal data to them.

The collection, storage and use of such data by ShareThis or the relevant social network is not controlled by Medaxis and Medaxis does not have access to the data collected. Please read the privacy policies of ShareThis and the relevant social networks carefully before using the relevant features. The privacy policy of ShareThis can be found here.

You can deactivate the collection of your usage and technical data by ShareThis by clicking on the "Do Not Track" link at the bottom of the ShareThis pop-up window that appears when you click on the ShareThis icon on our website. You will then be redirected to the ShareThis privacy policy where you can opt out by clicking the top button "Opt out now". You can also access this button directly here.

4. youtube

This website also contains videos provided by YouTube LLC ("YouTube"). The use of YouTube's offerings requires a connection to YouTube's servers in the USA. During this process, certain data is transmitted to YouTube. We have activated the data protection extension offered by YouTube for all videos embedded in our website. This means that YouTube only stores data about a visitor to our website if he/she plays an embedded video. The collection, storage and use of your data by YouTube is not controlled by Medaxis and Medaxis does not have access to the data collected. Please read YouTube's privacy policy carefully before using YouTube features.

For more information on the collection and use of your data by YouTube and your rights in this regard, please refer to YouTube's privacy policy at www.youtube.com.

5. google maps

This website uses Google Maps ("Google Maps"), a map service provided by Google, Inc. ("Google") to display interactive maps.

In order to be able to display the maps you have called up, your IP address is recorded by Google, which may be transmitted by Google to servers in the USA and stored there. In addition, Google may collect data about your use of Google Maps. Please note that Medaxis does not control the collection, storage and use of such data by Google and does not have access to the data collected. Please read Google's privacy policy carefully before using Google Maps features. You can find Google's privacy policy here.

By using Google Maps on our website, you agree to Google's terms of use, which you can view here.

If you do not consent to the collection of your data by Google through the use of Google Maps, you can prevent such data collection by completely deactivating the Google Maps service. To do this, you must deactivate JavaScript in your browser settings. Please note that you will not be able to use Google Maps in this case.

6. surveys

Medaxis may conduct surveys via this website. Unless otherwise stated, the personal data you provide to participate in these surveys will only be collected, processed and used to the extent necessary to complete the survey in question. Before you participate, we will inform you about what data we collect and how we intend to use the data collected.

Our survey forms are often generated using Wufoo, a service operated by SurveyMonkey Inc, 101 Lytton Avenue, Palo Alto, CA 94301, USA. We have entered into appropriate agreements to ensure that Wufoo collects and processes your data exclusively on our behalf and in accordance with our instructions. Wufoo will neither sell your data nor pass it on to third parties. Further details can be found here in Wufoo's privacy policy.

7. disclosure of your personal data

7.1 Medaxis operates this website as data controller.

7.2 In addition, Medaxis works with external technical service providers who are authorized to provide services on our behalf and in accordance with our instructions. These companies may have access to your personal data, but only to the extent that this is necessary for you to use our website, including the provision of our services or the processing of your inquiries or orders. For example, Medaxis may commission service providers to host our website or to store your data or to analyze the data collected in accordance with section 2. These service providers may not disclose your personal data to unauthorized third parties or use it for purposes other than those instructed. Some of these service providers may be located in countries outside Switzerland and the EU/EEA that do not guarantee the same level of data protection as in your home country. However, Medaxis has concluded appropriate contracts with these service providers to ensure that all necessary measures are taken to protect your personal data in accordance with the applicable requirements. If you have any further questions about our service providers, please contact us as explained in section 9 below.

7.3 Unless otherwise stated above, we will not transfer your personal data to third parties without your prior consent, unless we are legally obliged to do so.

8. storage of your personal data and data security

Your data is stored on servers in Switzerland. In addition, Medaxis may engage cloud service providers located outside Switzerland and the EU/EEA, including in the United States of America (USA), to host and process your personal data for storage, communication and marketing purposes. As the laws in these countries may not provide for the same level of data protection as is considered appropriate in Switzerland or the EU/EEA, we have taken the necessary measures to ensure proper handling and protection of your personal data and to ensure that it is processed exclusively on our behalf and in accordance with our instructions.

We treat your personal data confidentially. We have implemented appropriate technical and organizational security measures to protect your personal data from unauthorized disclosure, access, alteration, misuse, accidental or unlawful destruction or loss.

9 Your rights / How to contact us

In accordance with the provisions of the applicable data protection laws, you have the right to request information about the data we have stored about you. In addition, you have the right to request the rectification, erasure and/or blocking of your personal data and/or to object to the processing of your personal data on legitimate grounds.

Although we do not intend to make frequent changes to this policy, we encourage you to review our most current policy when you visit so that you can be sure that you are aware of the information we collect, how we use and disclose it, and that you consent to such processing.
