This Website Data Protection and Cookie Policy ("Website Data Protection and Cookie Policy") applies to the www.medaxis.ch website operated by Medaxis AG, Bahnhofstrasse 9, 6340 Baar, Switzerland ("Medaxis" or "we") (including all subpages from time to time) and/or other webpages of Medaxis ("Website"). This Website Data Protection and Cookie Policy does not apply to other webpages that are directly or indirectly linked to our website (e.g. via hyperlinks), irrespective of whether they are operated by Medaxis, an affiliated group enterprise or a partner enterprise.

This Website Data Protection and Cookie Policy applies to the capture, processing and application of personal data during your visit and/or your interaction on our website and explains our practice in relation to the placement of cookies, including the types of cookies we use and how you can manage them.

You are welcome to visit our website anonymously without providing your personal data.

You have the option of registering for our newsletter. Where you do so we request your consent to the storage and processing of your name and your email address. We use such data solely for the purpose of sending you regular updates by email about Medaxis's services and products. As part of your registration we also obtain your consent to our personalizing the content of our newsletter in line with your needs and interests based on the data received from you and stored about you, such as your account information, order history or other information provided by you (including, for example, your participation in surveys). Where you have also given your consent to the placement of cookies and to the monitoring of your user behavior on our website (see clause 2.2 below), we use data about your use of our website so you can receive personalized messages in line with your specific interests and preferences.

Once you have registered for the newsletter you will receive a confirmation email with a link. You need to click on this to confirm your registration. This two-stage activation process helps us ensure that the owner of the email account consents to receiving our newsletter.

By registering for our newsletter you also consent to your use of our newsletter, such as your opening of emails and email clicks, being recorded by Medaxis using an analysis tool of Campaign Monitor Pty. Ltd., Level 38, 201 Elisabeth Street, Sydney NSW 2000 (Australia) ("CampaignMonitor"). This tool also records data on the forwarding of emails, undeliverable emails and log-outs. The data captured by CampaignMonitor includes your name, your email address and your location.

Our service providers process this data as our service providers solely on our behalf and according to our instructions in order to facilitate our analysis of the use of our newsletter, to personalize your newsletter communications, to compile reports on newsletter activities and for other statistical and analytical services in connection with the use of our newsletter. Your data is not used for other purposes.

As your service provider may potentially be based in a country which, in certain circumstances, does not provide the same level of data protection as is regarded as appropriate in your home country, particularly in Switzerland and the EU/the EEA, we have taken the necessary steps to ensure that your personal data is adequately protected when being sent outside Switzerland and/or the EU/the EEA.

2.5 Use of Google Analytics' advertising features

Depending on the pages you visit on our website, we also use certain Google Analytics advertising features such as, for example, reports on demographics and interests, as well as remarketing features.

To enable these features, Google saves a "Doubleclick cookie" from a third-party provider on your device (where you view certain of our website's pages or webpages of other providers that have introduced advertising features based on Doubleclick cookies).

The Doubleclick cookie saves information on your use of our website (and potentially other pages viewed within the Google advertising network), including the pages visited, advertisements viewed, pages viewed, user interaction data, browser Information, IP address, a cookie ID and your search history. 3. ShareThis Social Plugin

The ShareThis service allows users to share the content of our website more easily via social networks such as facebook.com, twitter.com, LinkedIn.com and pinterest.com ("Social Networks“).

4. Youtube

This website also contains videos provided by YouTube LLC ("YouTube"). The use of YouTube services requires a connection to YouTube's servers in the USA. Certain data is sent to YouTube during this process. For all videos integrated within our website we have activated the data protection extension provided by YouTube. This means that YouTube data about a visitor to our website is only stored where he/she plays an integrated video. The capture, storage and use of your data via YouTube is not controlled by Medaxis and Medaxis has no access to the captured data. 5. Google Maps

This website uses Google Maps ("Google Maps"), a map service of Google, Inc. ("Google") to display interactive maps.

So you can be shown the requested maps, your IP address is captured by Google and may be sent by Google to servers in the USA and stored there. Furthermore, Google may capture data on your use of Google Maps. Please note that Medaxis does not control the capture, storage or use of such data by Google and has no access to the captured data. By using Google Maps on our website you declare your agreement to Google's terms and conditions of use, which you can view here.

Where you do not agree to the capture by Google of your data on your use of Google Maps, you can prevent any such data capture by completely deactivating the Google Maps service. To do so, you need to deactivate JavaScript in your browser settings. Please note that in this case you will be unable to use Google Maps.

6. Surveys

Medaxis may occasionally carry out surveys via this website. Unless indicated otherwise, the personal data sent by you for your participation in these surveys will only be captured, processed or used to the extent this is required in order to carry out the relevant survey or competition. Prior to your participation we will inform you which data we capture and how we wish to use the captured data..

The forms used in our surveys are often generated using Wufoo, a service operated by SurveyMonkey Inc., 101 Lytton Avenue, Palo Alto, CA 94301, USA. We have entered into corresponding agreements to ensure that Wufoo captures and processes your data solely on our behalf and according to our instructions. 7. Sharing of your personal data

7.1 Medaxis operates this website as the data controller.

7.2 Furthermore, Medaxis works together with external providers of technical services who are authorized to carry out services on our behalf and in accordance with our instructions. These organizations may be given access to your personal data but solely to the extent this is necessary for the use by you of our website, including the performance of our services and/or the processing of your inquiries or orders. Thus Medaxis may occasionally commission service providers to host our website or store your data or analyze the data captured under clause 2. These service providers are not permitted to pass your personal data on to unauthorized third parties or use this for purposes other than as indicated. Some of these service providers may be based in countries outside Switzerland and the EU/the EEA which do not provide the same level of data protection as in your home country. However, Medaxis has entered into appropriate agreements with these service providers to ensure that all necessary steps are taken for the protection of your personal data in accordance with the applicable requirements. Furthermore, Medaxis may commission providers of cloud services based outside Switzerland and the EU/the EEA, including in the United States of America (USA), to host and process your personal data for storage, communication and marketing purposes. As the laws in these countries may potentially not envisage the same level of data protection as is regarded as appropriate in Switzerland or the EU/the EEA, we have taken the necessary steps to ensure that your personal data is properly handled and protected and to ensure that it is processed solely on our behalf and in accordance with our instructions.

We treat your personal data confidentially. We have implemented appropriate technical and organizational security measures to protect your personal data against unauthorized sharing, unauthorized access, corruption, misuse and against accidental or wrongful erasure.
